Agenda Item 6. <br />City of Brea <br />PLANNING COMMISSION COMMUNICATION <br />TO:Honorable Chair and Planning Commission <br />DATE:12/08/2020 <br />SUBJECT:Conditional Use Permit No. 20-10, Precise Development Plan No. 20-04, And <br />Conditional Use Permit No. 20-18: A Request to Amend Planning Commission <br />Resolution No. 88-56 To Allow the Demolition of Two Commercial Buildings to <br />Construct A Restaurant with A Drive-Thru, and to Amend an Existing Sign <br />Program, at 255 East Imperial Boulevard, in the C-P (Commercial Professional) <br />P-D (Precise Development) Zone. <br /> <br />REQUEST <br />The Applicant, Mr. Javier Sola, representing Raising Cane’s Restaurant, is requesting a <br />Conditional Use Permit (CUP) and Precise Development Plan (PD) review to amend <br />Planning Commission Resolution No. 88-56 (Attachment J) to allow the demolition of two <br />commercial buildings totaling 9,588 square-feet, to construct a new 3,267 square-foot <br />single-story restaurant with a drive-thru, and associated site improvements. The Applicant is <br />also requesting a CUP to amend the existing Brea Gaslight Square Sign Program to allow <br />signage associated with the proposed project. <br />RECOMMENDATION <br />Staff recommends that the Planning Commission take the following actions: <br /> <br />1. Find the project exempt from the California Environmental Quality Act (CEQA) <br />pursuant to CEQA guidelines Section 15301 (Class 1, Existing Facilities) and Section <br />15303 (Class 3, New Construction or Conversion of Small Structures); and, <br /> <br />2. Approve CUP No. 20-10 to amend Planning Commission Resolution No. 88-56 to <br />allow a restaurant with a drive-thru, subject to the recommended conditions of approval <br />(Attachment B), and based on the findings and conclusions in the attached resolution <br />(Attachment A); and <br /> <br />3. Approve PD No. 20-04 to allow the demolition of two commercial buildings totaling <br />9,588 square-feet, and the construction of a new 3,267 square-foot single-story <br />restaurant, subject to the recommended conditions of approval (Attachment D), and <br />based on the findings and conclusions in the attached resolution (Attachment C); and <br /> <br />4.
